Terms of exclusive hire

1. What you book

Exclusive use of Agriturismo Fontallorso, Borselli, Caffarelli 56, 50060 Pelago (FI), operated by Valdarte Società Agricola S.r.l. (VAT 07538770483, CIN IT048032B5VAO5ZA3Y), for the dates and number of guests in your booking. No other guests stay at the villa during your stay. We, the owners, live in the house, and we or our staff are usually on site to help if you need anything.

2. Price

Prices are weekly rates for the whole property, charged pro rata per night (weekly rate ÷ 7 × nights), plus 10% VAT. The price includes water, energy, heating, tourist tax, a mid-week clean with fresh linen and towels, and use of every space and the equipment in it. Optional services we arrange for you are quoted and charged separately.

3. Payment

• Deposit: 30% of the total, paid by card when you book, as a confirmatory deposit (caparra confirmatoria, article 1385 of the Italian Civil Code). It counts towards the price. Your booking is confirmed when the payment succeeds.
• Except where we cancel (section 5), the deposit is non-refundable. That includes cancellation or a change of plans by you or your guests, illness, travel disruption, and a smaller group than planned.
• Balance: the remaining amount is due 30 days before arrival. If you book 30 days or less before arrival, the full amount is due at booking.
• If the balance is not paid on time, we may cancel the booking and keep the deposit.

4. Changing your dates

To move your booking, email us at info@valdarte.com. Dates cannot be changed online. We make the change for you if the new dates are available. There is no fee for the change. The price of the new dates applies, and anything already paid counts towards it.

5. Cancellation

• You may cancel your booking at any time by email. Cancelling is a right of withdrawal for which a fee is due (article 1373, paragraph 3, of the Italian Civil Code): more than 30 days before arrival, the fee is the deposit, which we keep; 30 days or less before arrival, the fee is the full price.
• If you cancel 30 days or less before arrival and we let the same nights to another group, we refund what that group pays us for those nights, up to the amount you paid above the deposit.
• If we have to cancel because the villa cannot be used, we refund everything you have paid.
• If you book as a private person, the 14-day right of withdrawal for distance contracts does not apply, because this is accommodation for specific dates (article 59, paragraph 1(n), of the Italian Consumer Code).
• Because the deposit is not refunded if you cancel, you may wish to take out cancellation insurance for yourself and your guests.

6. Damage deposit

A security deposit (deposito cauzionale) of €1,500 is paid on arrival, by card, bank transfer or cash. It is separate from the deposit in section 3 and is not part of the price. We return it within 10 days of your departure, less the cost of any documented damage. If something is damaged, we charge only what it actually costs us: if it can be repaired, the parts and the repairer's time; if it cannot, the cost of replacing it. We show you the receipts, never charge more than the real cost, and return the rest of the deposit. Normal wear and tear is never charged.

7. Number of guests

• At most 24 people may stay overnight. This is the villa's safe capacity and insurance limit.
• Guests beyond the number in your booking must be agreed with us in advance. In summer, if a booking made at the up-to-18-guests rate grows above 18, the difference to the full-house rate is due.
• We may refuse to let unannounced guests stay overnight beyond the villa's capacity.

8. Visitors and events

The villa is for the people staying in it. Day visitors, public events, concerts open to outside guests or parties need our permission in advance, and may be charged. Your own teachers, chefs and suppliers are welcome. Please tell us who is coming.

9. Your stay

• Check-in from 16:00, check-out by 11:00. After every stay we keep two full days for cleaning, so the next group can arrive on the third day after you leave. Arriving a day early to set up can be arranged on request, when the calendar allows.
• Italian law requires an identity document for every guest on arrival. Please send us the bedroom plan at least a week before arrival.
• You run your own programme: you can bring your own teachers, cook or chef, and suppliers. You keep the shared spaces tidy between our mid-week cleans and leave the studios as you found them.
• Quiet hours from 23:00. Our nearest neighbour is rarely here, but we live in the house. Please keep loud or amplified music to before 23:00, especially outdoors.
• Alcohol: if you or your guests serve or bring alcohol, you are responsible for it and for its consumption, and you will hold Valdarte Società Agricola S.r.l. harmless against any third-party claims arising from it, except in case of wilful misconduct or gross negligence on our part.
• The fire pit cannot be used in peak summer because of forest-fire risk. Pets only by prior agreement.

10. Photos and your marketing

You may not use the name, photos or videos of Agriturismo Fontallorso in your marketing without our written permission. Just ask, and tell us how you'd like to use them.

11. Insurance and responsibility

The villa is insured, including public liability for the guests who use it. The organiser is responsible for their programme, for the teachers, suppliers and visitors they bring, and for the conduct of their group during the stay, and will hold Valdarte Società Agricola S.r.l. harmless against third-party claims arising from them, except in case of wilful misconduct or gross negligence on our part.

12. Law

These terms are governed by Italian law. Nothing in them excludes or limits rights or liabilities that by law cannot be excluded or limited, including mandatory consumer protection rules.

13. Specific approval

Under articles 1341 and 1342 of the Italian Civil Code, you approve specifically, with the separate box on the booking form, clauses 3 (non-refundable deposit; cancellation if the balance is not paid), 5 (cancellation), 9 (alcohol and indemnity) and 11 (organiser's responsibility).
